Almost Opened a Zecco Account

I have been researching brokers to open a new “arbitrage” brokerage account as an experiment on my fairly successful ETF covered call trades. I’m planning on executing a few covered calls on ETFs to gain at least an 8% return on my money over a 60 to 90 day peroid. The biggest bite out of my returns are the brokerage commissions and Zecco appeared very appealing with zero commissions until I read the Terms of Service.
The particularly disturbing section included the following
You also understand and agree that the Service may include advertisements and that these advertisements are
necessary for Zecco to provide the Service….You agree not to access the Service by any means other than through the interfaces that are provided by Zecco for use in accessing the Service.
There are a few references to Zecco’s Privacy Policy and upon reviewing that document, I spotted some troubling wording
(2) we may share limited information with third parties to assist in the analysis of customer demographics, business analysis and marketing strategies; these third parties must agree to strict confidentiality provisions to assure the protection of your information;
The issue, of course, is that Zecco seems all to willing to sell/share my personal info to third parties and appears to make a half-hearted attempt to say that my info will be protected. What does “these third parties must agree to strict confidentiality provisions” mean?
What is the penalty if they violate these provisions? What recourse is taken if my info is misused?
Worse yet is that I’ll have to sit through ads while accessing my brokerage account. Do I really need the distraction of ads while I’m trying to make a trade? If I use Adblock am I violating the terms of service since I’ve agreed not to access via any interface not provided by Zecco? What kind of spyware will I end up with on my machine?
Perhaps my biggest gripe is that Zecco is promoting itself as a commission “free” broker when in fact they sound more like a marketing machine ready to SPAM me to death with ads, third party offers and who knows what else. The “free” commissions aren’t really free when my personal info is being sold on the auction block to the highest bidder.
I wonder if this is the new information age future for consumers. GM doesn’t make money selling cars any more, they make money financing the cars. Brokers don’t make money on commissions but selling personal info to marketing companies. Oh well, I’ll keep looking for a decent broker.

Ummm, my bank, and every bank that I’ve ever seen has a similar privacy policy toward third parties. My mortgage lender has a similar thing. It’s next to impossible to keep your data private and live in this world. You might as well get something free out of it.
I’m sure that Zecco isn’t going to infect your machine with spyware. They’d go out of business instantly if that were the case. Plus as a financial institution they have to go through various federal regulations. They aren’t going to spend months fine-tuning their system though that, just to infect people with spyware. There are much, much easier ways.
By using Adblock, I don’t think you’d violate the terms of service. You are still using an interface provided by Zecco. You are just modifying how you view the service on your end. Not that it matters, but they would have no way of knowing anyway.

Please let me know how bad the ads are if you’re using Zecco. With Bank of America offering commission free trading (with no ads?) then I have to wonder if I should really put up with them.

Thanks for writing about Zecco. In the trading interface, there aren’t a ton of ads. The third parties that we share information with consist of ASPs which help us monitor where traffic and prospects are coming from. We don’t sell your personal information to anyone. In fact, the Zecco.com marketing staff does not have access to your information. This data is held closely by the licensed Zecco Trading brokers. Adblock doesn’t violate our terms of service. We don’t use spyware. We do use an encrypted cookie to facilitate using the service. That’s it. Come check us out. Forget about unnecessary commissions and join the free trading revolution.

Ads on site– not that bad.
Spam emails the send– bad bad bad. After I signed up with an email address unique to zecco only (I gave it to no one else), I am getting 12-15 pump and dump stock scam emails a day. Their customer service never replied to my complaints (yes, I am opted out of getting emails per the My Account page) and any posts you put on their forums regarding the matter get promptly removed buy their admins.

In the cancellation and termination portion of the TOS, I would really like clarification as to what Zecco’s deciding factors are in terminating an account. The reason for such an action is not defined more than saying that they may use their sole discretion.
Another problem is in the latter section of the TOS it is stated that “NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.” This makes the previous statement by Sabin almost void as what he is saying is not clearly stated in the Terms of Service.
I may be mistake, but it seems like a rather odd Terms of Service as a whole.

Seems too many people have been unhappy with Zecco. They recently changed their free trading policy. My guess is that it won’t be long before they get bought out or go out of business.

Regardless of their future, I have been searching for an online investment provider and I think that I am going to stick with one of the big dogs. Most all of them have such comparable fees and perks that I am pretty sure it comes down to each individual’s preference. Good luck to you, though.

Stay away from Zecco.
They lost me over $50,000 over this year, all because of their “margin requirements”. They exercised unauthorized trades in my account, even though I had enough cash, had a margin account, and was not using any of their money (did not borrow anything!).
Their software is vastly inferior to other brokerages. They send you completely outdated information or provide no information on margin calls which they then upload just at the last minute and ante-date it so to appear as if they sent it a day before. They also can mark your account as a day trading account even though you had not made any trades at all!
I am currently seeking an arbiter to file a complain. Please, if you know a good one let me know. I also would join any class suit against this company.
